Answer: Sure. The potential penalties are pretty much the same as DUI. However, there’s not as many charged, and some people don’t deem it as much of an offense because there aren’t that many fatalities as to boating in the area as far as alcohol is concerned. But it does not have an effect on anybody’s regular driver’s license. The way that the statute is written for any driving offense, it’s driving a motor vehicle on a highway or road.
So, the boat, there is no cognizant boating law. It may possibly have some kind of effect on your boating license, but it does not have any effect whatsoever on your driving license. And that’s why sometimes it’s deemed not as serious an offense, because there’s no subsequent issues with the MVA—you’re not going to get any points, you’re not going to get your driver’s license revoked or anything like that.
